NOTICE OF COMPLAINT TO QUIET TITLE
TO: DAVID R. OWENS, KAREN J. OWENS, UVA I THOMAS, PHILIP A. WHITEMAN, V. IRENE WHITEMAN, CHARLES B. FRALICK, MARY ELIZABETH FRALICK, WILLIAM P. RONDEAU, LINDA RONDEAU, EARLE R. HANLIN, THE UNKNOWN HEIRS, DEVISEES AND LEGATEES OF ANY OF THE ABOVE PERSONS WHO ARE DECEASED AND ANY PERSONS CLAIMING AN INTEREST IN THE REAL ESTATE DESCRIBED HEREIN
You are hereby notified that the Plaintiffs has filed its action in this Court to quiet title as to the following described real estate located in Kosciusko County, Indiana, to-wit:
This original description is part of property with unknown ownership at this time, being a tract of land in the Northeast Quarter of Section 20, Township 33 North, Range 7 East, Tippecanoe Township, Kosciusko County, Indiana and is from a survey by Ryan Prince dated August 19, 2024. Job Number 24-0712 with Prince Land Surveying and is more particularly described as follows:
Commencing at the East corner of David and Karen Owen’s property described as Tract-I in Deed Record 332, page 461, being 1548.4 feet South of the Northeast corner of the Northeast Quarter of said Section 20; thence North 11˚55’13” West (basis of bearings established by J.K. Walker & Associates survey recorded in Document Number 2024020489), along the East line of said Owen property, 60.80 feet to the Northeast corner of said Owen property; thence South 86˚24’00” West, along the North line of said Owen property, 141.30 feet to a wood post at the Northwest corner of said Owen property and the Point of Beginning; thence South 11˚09’04” West, along the West line of said Owen property, 36.00 feet more or less to the waters edge of Grassy Creek; thence Westerly, along said waters edge, 63.2 feet more or less to a point of the East line of David and Karen Owen’s property described as Tract-II in Deed Record 332, page 461; thence North 11˚09’04” East, 30.00 feet more or less to the Northeast corner of said Tract-II; thence North 86˚24’00” East, 63.06 feet to the Point of Beginning, containing 0.04 acres more or less.
Subject to a non-exclusive 15 foot easement for the purpose of ingress and egress as recorded in David and Karen Owen’s Deed Record 332, page 461.
If you claim an interest in the real estate you, or your attorney, must file an answer or other response to Plaintiffs’ complaint not later than thirty (30) days following the last date of publication of this notice. If you fail to so appear or respond, the Court may grant Plaintiffs the relief requested in the complaint.
