TO VACATE A PUBLIC STREET IN THE PLAT OF SILVER LAKE,
KOSCIUSKO COUNTY, INDIANA
TO THE CITIZENS OF KOSCIUSKO COUNTY INDIANA
YOU ARE HEREBY NOTIFIED that a Petition has been filed with the Town Council of Silver Lake, of Kosciusko County, Indiana, by David Basham, requesting the vacation by ordinance of a public way in the plat of Silver Lake, Kosciusko County, Indiana, more particularly described as follows:
A. That part of South Street lying South of Lot Number 1, together with that part of an alley lying West of Lot Number 1, all being in Sell’s South Addition to Silver Lake, Kosciusko County, Indiana (This description prepared by Ryan D. Peppier, LS22300014, as part of original survey GK-158 “A” completed by J.K. Walker & Associates, P.C., dated September 12, 2025), being more particularly described as follows, to wit:
BEGINNING at an iron pin found at the Southeast corner of said Lot Number 1; thence S00°-44’-14”W (GPS Grid bearing and used as the basis of bearings for this description), on and along the Southerly projection of the East line of said Lot Number 1, a distance of 41.26 feet to the point of intersection with the South line of South Street as platted in Sell’s Southern Addition, said point being situated N89°-40’-08”E, a distance of 2.0 feet from a 5/8-inch iron pin capped “Walker”; thence S89°-40’-08”W, on and along said South line, a distance of 288.75 feet to the point of intersection with the West line of the platted alley lying West of said Lot Number 1, said point being situated 0.3 feet West of the West face of a 14-inch concrete post, said point also being situated 1.9 feet North and 0.6 feet West of an iron pin found; thence N00°-44’-12”E, on and along said West line, a distance of 107.26 feet to a 5/8-inch iron pin capped “Walker” at the point of intersection with the Westerly projection of the North line of said Lot Number 1; thence N89°-40’-08”E. a distance of 24.75 feet to a 5/8-inch iron pin capped “Walker” found at the Northwest corner of said Lot Number 1; thence S00°-44’-14”W, on and along the West line of said Lot Number 1, a distance of 66.00 feet to the Southwest corner of said Lot Number 1; thence N89°40’-08”E, on and along the South line of said Lot Number 1, a distance of 264.00 feet to the point of beginning, containing 0.31 acres of land, more or less, subject to all legal right-of-way, subject to all legal drain easements and all other easements of record.
YOU ARE HEREBY NOTIFIED that the Town Council of Silver Lake, Kosciusko County, Indiana, has set the Petition for hearing at 7:00 p.m. on November 12, 2025 at the Silver Lake Town Hall, 604 N. Jefferson St., Silver Lake, IN 46982.
Any person may appear and be heard upon the Petition at the time, date and place above scheduled for hearing and/or may send written comments or response to the Town Clerk of Silver Lake, PO Box 159, 604 N. Jefferson St., Silver Lake, IN 46982.
After hearing, the Petition may be granted, denied or continued and an ordinance may be introduced and passed according to law, providing for the vacation of said alley and street.
